Executors Resource — Website Terms of Use


1. About These Terms

These Terms of Use (the “Terms”) govern your access to and use of this website and everything offered on it, including any pages, content, tools, and the online application or client platform that we make available (together, the “Site”). The Site is operated by Executors Resource LLC, a Wyoming limited liability company (“Executors Resource,” “we,” “us,” or “our”).

By visiting, browsing, or otherwise using the Site, you agree to these Terms. If you do not agree, please do not use the Site.


2. The App and the Separate Terms of Service

Part of the Site is an online application (the “App”) that clients receive access to when they hire us. Your access to and use of the App is governed by our separate Terms of Service, which are made available within the App and at the App’s URL.

By accessing or using the App, you agree to be bound by those Terms of Service in addition to these Terms of Use. The App’s Terms of Service set out the specific rules for the services clients order through the App, including engagement, fees, payment, and related matters. If anything in these Terms of Use conflicts with the App’s Terms of Service with respect to your use of the App, the App’s Terms of Service control for the App. You can review the App’s Terms of Service when accessing the App.


3. Who May Use the Site

You may use the Site only if you are at least 18 years old and able to form a binding contract with us, and only in compliance with these Terms and all applicable laws. If you use the Site on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.


Executors Resource is not a law firm and does not provide legal advice or legal representation. The Site, including its content, document templates, knowledge base, and videos, provides general information and self-help tools only. Using the Site does not create an attorney-client relationship between you and Executors Resource, and no attorney-client privilege attaches to your communications with us. For advice about your specific situation, you should consult a licensed attorney or other qualified professional.

Information on the Site is general and is not a substitute for legal, tax, or financial advice. We do not guarantee any particular outcome, including that a court will accept or approve any filing.


5. Accounts

Some features of the Site, including the App, require an account. You are responsible for the information you provide, for keeping your login credentials confidential, and for all activity that occurs under your account. Please notify us promptly if you believe your account has been used without your authorization.


6. Acceptable Use

When using the Site, you agree not to:

  • Use the Site in any way that violates applicable law or regulation;
  • Copy, reproduce, distribute, sell, or create derivative works from the Site or its content except as expressly permitted;
  • Attempt to gain unauthorized access to the Site, other accounts, or our systems or networks;
  • Interfere with or disrupt the operation, security, or integrity of the Site;

7. Intellectual Property

The Site and its content, including text, document templates, graphics, logos, software, and the knowledge base and videos, are owned by Executors Resource or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site for your own lawful, non-commercial use, subject to these Terms. Access is not IP ownership. We retain all ownership. All rights not expressly granted are reserved.


The Site may contain links to third-party websites or services that we do not control. We provide these links for convenience only and are not responsible for the content, products, or practices of any third party. Your use of any third-party website or service is at your own risk and subject to that third party’s terms.


9. Disclaimers

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, error-free, or that any content is accurate, complete, or current. You accept the inherent risks of electronic communication and storage, including interception, unauthorized access, corruption, and viruses.


10. Limitation of Liability

To the fullest extent permitted by law, Executors Resource will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits or lost opportunity, arising out of or relating to your use of the Site. Our total liability for any claim relating to the Site is limited to the amount, if any, you paid to us for the use of the Site giving rise to the claim. You agree to indemnify and hold harmless Executors Resource and its members, managers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or your violation of these Terms.

We may modify, suspend, or discontinue all or part of the Site at any time. We may also update these Terms from time to time. Changes are effective when posted to the Site or otherwise provided to you. Your continued use of the Site after changes are posted means you accept the updated Terms.


13. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Site will be brought in a court of competent jurisdiction in Houston, Harris County, Texas.


14. Miscellaneous

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with any terms referenced here (including the App’s Terms of Service for your use of the App), are the entire agreement between you and us regarding your use of the Site.
