These Terms of Use (“Terms”) govern your access to and use of executorsresource.com (the “Site”) and the services and online platform offered by Executors Resource LLC (“Executors Resource,” “we,” “us,” or “our”) (together, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

Not a law firm; no legal advice

Executors Resource LLC is not a law firm, and we do not provide legal advice, legal representation, or legal opinions. Information provided through the Services is for general informational and administrative purposes only and is not a substitute for advice from a licensed attorney. Participating attorneys are independent and are solely responsible for the legal services they provide. Using the Services does not create an attorney-client relationship with Executors Resource.

Description of the Services

Executors Resource provides technology-driven estate administration support to Texas families, including organizing estate matters, preparing and assembling documents for attorney review, coordinating with professionals, and handling administrative tasks through an online portal. The court appearance and legal document review are performed by independent, licensed attorneys, not by Executors Resource.

Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Services. If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate, complete information and to keep it up to date.

Fees and payment

Fees for the Services are described at the time of engagement. Where applicable, Executors Resource collects fees from clients and remits payment to participating attorneys and other professionals. Unless otherwise stated in a written agreement, fees are due as described at the time of engagement and may be non-refundable once work has begun. Payments are processed by a third-party payment processor, and your use of payment features is subject to that processor’s terms.

Your responsibilities

  • Provide accurate and complete information about the estate and related matters.
  • Use the Services only for lawful purposes and in compliance with these Terms.
  • Do not upload content that is unlawful, infringing, or that you do not have the right to share.
  • Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the Services.

Participating attorneys

Independent attorneys who work with Executors Resource are not employees or agents of Executors Resource. Signing up as a participating attorney does not guarantee work or referrals. The relationship between a client and any attorney is solely between those parties.

Intellectual property

The Site, the platform, and their content, including text, graphics, logos, and software, are owned by or licensed to Executors Resource and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. You retain ownership of the information and documents you submit, and you grant us a license to use them as needed to provide the Services.

Third-party links and services

The Services may link to or rely on third-party websites and providers. We are not responsible for the content, policies, or practices of third parties, and your use of those services is at your own risk.

Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any particular outcome will result from using them.

Limitation of liability

To the fullest extent permitted by law, Executors Resource and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Services. To the extent liability cannot be excluded, our total liability is limited to the amount you paid us for the Services giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Executors Resource and its members, employees, and contractors from claims, damages, and expenses arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute relating to the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Texas.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
